On November 18, 1872, the complainant and one •Joseph E. Davis jointly executed a written instrument, the stipulations of which, necessary to be stated, are as follows: “ I, the said Joseph F. Davis, for the consideration of one dollar and the agreements hereinafter mentioned, hereby bargain, sell and convey unto A. G.
