The issue before the Court is whether a creditor may recoup prepetition advances on Medicaid claims payments from post-petition Medicaid payments due to the Debtor.
The material facts are not in dispute. The Debtor, CDM Management Services, Inc., d/b/a Vinewood Nursing Home, is a nursing home facility. The Debtor participates in the Medicaid Program and serves eligible beneficiaries in accordance with 42 U.S.C. § 1396 et seq.
