This was an action in the district court for Lancaster county to foreclose a mechanic’s lien for the sum of $417.14, alleged to he due the plai. 'iff on a contract for the erection of a dwelling-house for the defendants. By the terms of the contract defendants were to pay plaintiff the sum of $8,000 for the. completion of the work. It was alleged that defendants had only paid plaintiff the sum of $2,610, and had failed to pay the balance of $390, although often requested so to do.

It appears that plaintiff had duly perfected its mechanic’s lien on the premises, and that fact was not denied.…
