Plaintiff filed a suit in assumpsit on a family automobile policy issued to plaintiff by defendant.

The following facts are not disputed:

The vehicle, covered by the policy, while driven by Robert Theos, son of plaintiff, was involved in an accident which caused personal injuries to Jeffrey B. Carr, causing his death.
