From. Hamilton Circuit Court; Ernest E. Gloe, Judge. Action by tbe Reserve Loan Life Insurance Company against Horace Gr. Brown and another, in which John L. .Dulin, receiver of the Hamilton Trust Company, was admitted on his petition as a party defendant. From a judgment for the receiver, the plaintiff appeals.

The appellant filed suit in the Hamilton Circuit Court against Horace Gr. Brown and Nell Brown to foreclose a certain real estate mortgage in the sum of $3,500, made to the Hamilton Trust Company, and assigned to appellant, and at the same time filed another separate suit against the same defendants, to foreclose another certain mortgage in the sum of $3,600, executed by said defendants to said Hamilton Trust Company, and assigned to appellant.
