This is an action to recover damages for breach of contract. Under the view we take of this case, the following are the material facts: Plaintiff’s cause of action is based upon his amended petition, wherein he alleged that for a long time prior to February 21, 1929, he was the owner of a cotton gin at Newby, Okla., and operated under a permit from the Corporation Commission in the name of “Newby Gin Company.” It was alleged that on February 21, 1929, the defendants E.
