Miller, J.

The plaintiffs appeal from the judgment dismissing their suit and dissolving their attachment.

It seems that the firm of Milmo, Stokoe & Go., composed of B. Milmo, Mrs. Stokoe and Henry B. Hewes,was dissolved by the death of Milmo. Another member, Mrs. Stokoe, died. Baxter, tbe defendant, became executor of Milmo and tutor of his minor children, and the heirs of Mrs. Stokoe were represented by their uncle, J. W. Stokoe.
