Appeal by The Grade Crossing Commissioners of the City of Buffalo and others from an order of the Supreme Court, made at the Erie Special Term and entered in the office of the clerk of the county of Erie on. the 15th day of September, 1899, confirming the report of commissioners of appraisal appointed under chapter 255 of the Laws of 1890 and the acts amendatory thereof.

McLennan, J.:

The act in question provides, among other things, as follows: “ The court shall appoint three disinterested freeholders of the city of Buffalo commissioners to ascertain and report the just compensation to be paid to the owners and parties interested in the lands, for taking the same or for the injury thereto, and shall name the time and place for the first hearing before the commissioners.
