In an action, inter alia, to recover damages for breach of contract and for an accounting, the plaintiff appeals from an order of the Supreme Court, Rockland County (Weiner, J.), dated May 6, 2005, which granted the defendants’ motion to dismiss the complaint pursuant to CFLR 3211 and 3212.
Ordered that the order is modified, on the law, by deleting the provisions thereof granting those branches of the defendants’ *396motion which were to dismiss the first and third causes of action and substituting therefor provisions denying those branches of the motion; as so modified, the order is affirmed,…
