DAWSON, J.:
The plaintiffs and defendants were rival claimants to the estate of Thomas Jarrard. The probate court of Edwards county gave judgment in favor of the McCarthy line of heirs. The plaintiffs appealed to the district court.
To comply with sections 3625 and 3626 of the General Statutes of 1909, counsel for plaintiffs filed the following as a notice of appeal and affidavit:
“Come now the attorneys, M. A. Merten and F. L. Slaughter, who represent the Jarrard line of claimants as heirs, and give notice of appeal from the decision of this court…
