People v. McCary
California Court of Appeal
1Opinion of the Court
Opinion
MERDNG, J. *
Defendant appeals from a judgment sentencing him to three years in state prison after the trial court denied his motion to withdraw pleas of guilty to two counts of committing a lewd and lascivious act upon a child under 14 years of age (Pen. Code, § 288, subd. (a)). We conclude defendant was denied effective assistance of counsel in entering his pleas. We shall reverse and remand the case to the trial court to provide defendant an opportunity to withdraw his pleas.
