These consolidated appeals arise from two separate petitions for guardianship of Susan Boyle. The Department of Human Services, Bureau of Elder and Adult Services (the Department) appeals from an April 15, 1994 judgment of the Penobscot County Probate Court (Woodcock, J.) denying its petition for guardianship of Susan. The Department *913contends that the court erred in concluding that Susan was not an incapacitated person.
