Lula Hickey Thomas, the beneficiary named in a $5,000 policy of life insurance issued by the government on the life of Casper W. Hinds, a deceased soldier, brought suit to recover the amount of the policy. The district court held that the beneficiary, who was the aunt of Hinds, did not stand in loco parentis to him and, therefore, was not entitled to recover under the provisions of the National Service Life Insurance Act, 38 U.S.C.A. §§ 801 et seq., as amended.
