IN error from the circuit court of Franklin county; Hon. Stanhope Posey, judge. Hickingbottom filed his complaint against Long to the March term, 1853, of that court. The complaint contains three counts. The first count alleges, that on the 6th of December, 1848, Long offered to sell Hickingbottom a slave, named Jane, then in Long’s possession, for $>250. This is a writ of error to a judgment of the circuit court of Franklin county.
The error assigned is, that the court below erred in overruling the defendant’s motion for a new trial, which was sought to be supported on the ground that the damages were excessive, and the verdict in other respects contrary to law and evidence.
The action was brought to recover damages for an alleged breach of warranty as to the title of the defendant to a slave, which he had sold to the plaintiff.
