This suit was instituted in the District court of Potter county, Texas, by the plaintiff, Long Bell Lumber Company, a corporation, against the defendant I. M. Futch, and his wife, Bessie Futch, to recover the sum of $1,223.50, and to foreclose a mechanic’s lien note alleged to he held by it as security for the payment of the debt.

Plaintiff alleges: That about September 1, 1926, the defendant I. M. Futch orally requested it to furnish defendants building materials for the erection and construction of improvements on lot No. 13 in block No. 1 of the country club district, an addition to the…
