This was a bill in chancery filed by the defendants in error in the Superior Court of Cook county, against the city of Chicago and the plaintiff in error, Richard Rusk, to enjoin the city from proceeding to have a certain special assessment confirmed, which had been levied to pay a certain judgement of $4500 and costs, which judgment had been rendered in favor of said Rusk in a certain condemnation proceeding, as the alleged owner of a strip of land thirty-three feet wide lying along the north side of block 12, of Ogden’s subdivision of the south-west quarter of section 18, in township 40,…
