Matteson, C. J.(1) This is a bill to obtain a construction of the will of Ehoda Newcomb, and for the distribution of certain funds held by the respondent, the Ehode Island Hospital Trust Co., in its capacity as trustee under the will and in other capacities.

The will of Ehoda Newcomb was executed February 1, 1857, and purports to dispose both of her own estate and the estate of her deceased husband, Henry S.
