FRUGÉ, Judge.

Plaintiff, L. D. Dupre, appeals from a judgment dismissing his workmen’s compensation action against the defendants, Evangeline Timber Company, Inc. and the Fidelity and Casualty Company of New York. We affirm.

Plaintiff filed suit on February 1, 1974, against the estate of Roosevelt Campbell, as his employer, and the Fidelity and Casualty Company of New York for injuries resulting from an accident which took place on July 3, 1973.
