This Court granted relator's petition for alternative writ of mandamus and prohibition on December 15, 1982.
The controversy arises from a marital dissolution occurring in May, 1979. Relator was granted custody of two minor sons borne to the marriage. On May 18, 1982, relator's ex-husband filed a "Petition to Reinstate Surname of Children to That of Natural Father" in respondent court. From an affidavit filed by relator, we glean the minor children requested they be allowed to use the relator's maiden name of Wade rather than their father's surname, Schmailtz.…
