In an action, inter alia, to recover damages for medical malpractice, etc., the defendants appeal, as limited by their brief, from so much of an order of the Supreme Court, Dutchess County (Fagones, J.), dated September 29, 2009, as denied their motion to dismiss the second cause of action pursuant to CELR 3211 (a) (7), and, in effect, to strike the allegations in the bill of particulars corresponding to that cause of action.
Ordered that the order is reversed insofar as appealed from, on the law, with costs, and the defendants’ motion to dismiss the second cause of action pursuant to CELR…
