GRANT, Judge:
Defendants Sunset Boulevard Car Wash Corporation [Sunset] and Robert Bush, its sole owner, timely appeal from the April 15, 1992 Order of the United States District Court for the Central District of California granting the summary judgment motion of the United States of America and denying defendants’ motion to dismiss the complaint.1 The court entered judgment in favor of the government on May 18, 1992. *510For the reasons stated below, we affirm the determinations of the district court.
