KASOLD, Judge:

The appellant filed through counsel a December 18, 2003, application for attorney fees and expenses pursuant to the Equal Access to Justice Act (EAJA), as codified in part at 28 U.S.C. § 2412(d). For the reasons set forth below, the Court will grant the application.

I. BACKGROUND

On December 1, 2003, the Court granted the parties’ joint motion to vacate a June 2, 2003, Board of Veterans’ Appeals (Board) decision that had denied the appellant’s claim of entitlement to an effective date for the award of special monthly compensation prior to March 26, 1993.
