*632The defendant was indicted for the crime of murder, and was convicted of murder in the first degree. After the indictment was found, and when he was called upon to plead to it, he moved to set it aside on the alleged ground that the grand jurors, who found the indictment, had formed and expressed an opinion that he was guilty of the offense charged, prior to their being impanneled; and that prior to the finding of the indictment he had not been held to answer for the offense.
