Appeal from a judgment of the County Court of Fulton County (Best, J.), rendered November 20, 1985, convicting defendant upon his plea of guilty of the crime of burglary in the second degree.
Defendant was arrested on April 5, 1985 by David Goodier, a Deputy in the Fulton County Sheriff’s Department, for petit larceny, upon the complaint of Nichol’s Department Store in the City of Johnstown.
