Vermon Frink appeals from his conviction of the offense of cruelty to children. Frink and his wife, Jacqueline, were indicted and tried for alleged acts of cruelty to her son, Deangelo. During the trial, Jacqueline entered a plea of guilty and testified for the state against her husband. Her son, Deangelo, was four years of age at the time, and because she and her husband were working different shifts at their places of employment, Deangelo had to be placed with a day care center.
