(1) The transactions shown in the record between the Missouri railroad companies and the Illinois company are tantamount to a consolidation, regardless of the name applied to such transaction, and by virtue of such consolidation the Chicagp, Burlington & Quincy Railroad Company became a domestic corporation in respect to all of its acts in Missouri.

The record in this cause has come here in the return of a writ of certiorari issued out of this court to the circuit court of Buchanan county. The relator had filed in that court a suit against the Chicago, Burlington & Quincy Railroad Company and Thomas O'’Phelan for damages for the death of her husband who she alleged in her petition was killed through the joint negligence of the two defendants.
