This is a suit for damages resulting from personal injuries alleged to have been sustained by plaintiff as tbe result of negligence of defendant. Plaintiff was a gripman employed by defendant and' at tbe time of injury, August 20, 1901, was engaged in tbe discharge of tbe duties of such service upon a train of cable cars in operation upon tbe Fifteenth street line of defendant’s street railway system in Kansas City.
