Appeal from a judgment (denominated order) of the Supreme *1027Court, Erie County (Eugene M. Fahey, J.), entered December 23, 2003. The judgment denied plaintiffs motion for partial summary judgment, granted the cross motion of defendant Fidelity and Guaranty Insurance Underwriters, Inc. for summary judgment dismissing the complaint against it and denied plaintiff’s cross motion for an order vacating the stay on discovery.
