Respondent, George W. Carlisle, applied for old age assistance benefits December 2, 1957. The application was rejected February 19, 1958, on the basis that he had transferred cash to his daughters without receiving a valuable consideration as required by statute. From this decision he perfected an appeal and a hearing was held before a Referee on June 25, 1958. Respondent appealed this decision to the Circuit Court of New Madrid County, and, on November 10, 1959, the court entered a judgment finding that the director’s decision was arbitrary and unreasonable and remanded the…
