*238The appellants, Marshall Stanley and Will Nix, together with two others, Major Kitchen and Baby Britt, alias Will. Smith, were indicted by the grand jury of Harlan county for the murder of Shelby Turner, and upon their separate trials they were found guilty and their punishment fixed by the verdict at confinement in the penitentiary during-their natural lives, upon which verdict the court pronounced judgment and their motion for a new trial having been overruled, they prosecute this appeal.
