The plaintiff in error, Peter Kosearas, seeks a review of his conviction by a jury in the circuit court of De Kalb County, which resulted in his being sentenced to the Illinois State Penitentiary for a minimum term of three years and a maximum term of five years. He was charged with uttering a fictitious check with intent to defraud, in violation of the Criminal Code, division I, section 279. This court in People v.
