delivered the opinion of the court.

This is an appeal from an order of the circuit court of DuPage county awarding a writ of mandamus against the board of trustees of the police pension fund of the Village of Hinsdale. The parties waived a jury trial and .submitted the issues of fact to the court for decision. The order directs the writ of mandamus to command said board to forthwith pay to relatrix a pension at the-rate of $800 per year, payable in monthly instalments of $66.66 to commence April 29, 1931.
