Appeal from judgment of the General Term of the Supreme Court in the fourth judicial department, entered upon an order made February 3, 1891, which affirmed a judgment in favor of plaintiffs entered upon the report of a referee. This was an action to recover the amount, with interest, of five drafts sent to the Rational Park Bank of Rew York by Justus S. F. Crim, deceased, plaintiffs’ testator, and credited to the firm of Crim & Starkweather.
