Taylor, C. J.:

At the Fall term, 1897, of the Circuit Court of *453Holmes County, William Padgett, the plaintiff in. error, was tried upon an indictment charging him with murder, and was convicted of manslaughter and sentenced to- fifteen years confinement in the penitentiary, and from such sentence comes here- on writ of error.

The indictment, omitting its formal parts, is as follows: “That one William Padgett, late of the-County of Holmes aforesaid, in the circuit and State aforesaid, on the 5th day of May, in the year of our Lord one thousand, eight hundred and ninety-seven, with force and arms,…
