The defendants appealed to the Appellate Division of the Superior Court from a judgment of the Hudson County Court rendered upon a jury verdict in favo.r of the plaintiff for $5,000 plus interest. We have certified the cause on our own motion for argument and decision here. The suit was brought for the recovery of a broker’s commission on an oral contract made on December 20, 1947, whereby the defendants agreed to pay the plaintiff a commission of five per cent, if it would obtain a purchaser for three designated embroidery machines…
