JTB Tools & Oilfield Services, L.L.C. (“JTB Tools”) challenges the dismissal of its lawsuit against the United States, the Assistant Secretary of Labor, Occupational Safety and Health, and the Director of the Directorate of Standards and Guidance for the Occupational Safety and Health Administration (collectively “OSHA”). Specifically, JTB Tools alleges that the district court erred in granting OSHA’s Rule 12(b)(1) motion to dismiss for lack of subject-matter jurisdiction and in transferring this case to this court.
