American Home Assurance Company (“American Home”) filed a declaratory judgment action against Alvin McCladdie, seeking to absolve itself of liability for additional optional personal injury protection (“PIP”) benefits under an automobile liability insurance policy issued to McCladdie’s mother, America Luke (“the insured”).
