In an action, inter alia, to rescind an agreement, defendants appeal, as limited by their brief, from stated portions of a judgment of the Supreme Court, Suffolk County, dated October 25, 1979, which, inter alia, granted plaintiff judgment on his second cause of action, rescinding said agreement. Plaintiff cross-appeals, as limited by his brief, from so much of the judgment as failed to order the return to him of $50,000.
