The indictment against the defendant, who was at the time of issuing the certificate of election to Edwards, the governor of the state of Arkansas, is founded upon section 22 of the act of congress of May 31, 1870 (16 Stat. 1451. The amendatory act of February 28. 1871 (16 Stat. 4331, does not apply to the case, since the indictment is for an act committed before its passage, and is not based upon section 20, which this last-uamed statute amends, but alone upon section 22, above-mentioned.
