Plaintiffs, the children of James A. Smith and his wife, Mrs. Amanda Smith, allege that they are owners, as heirs of their deceased father, of an undivided one-half interest in the E. % of the S. E. % of section 10, and the W. % of the S. W. % of section 11, all in township 12 north, range 1 west, now in possession of defendant; further, that their father entered said land as a homestead during the existence of the community of acquets and gains existing between him and their mother; that he and his family resided on the land, and cultivated it, for more than five years, during the existence…
