Judgment of the Supreme Court, New York County (Carol Berkman, J.), rendered May 18, 1993, convicting defendant, upon his plea of guilty, of criminal possession of a controlled substance in the fourth degree, and sentencing him to a prison term of three to six years, as amended by order of the same court and Justice, entered on or about March 20, 1996, which, after a hearing de novo, adhered to the court’s prior decision and order denying defendant’s motion to vacate the judgment pursuant to CPL 440.10 in its entirety, unanimously affirmed.
