This motion for judgment was tried before a jury on March 7, 1989. The Court took under advisement the defendant’s motion to strike the evidence at the conclusion of all of the evidence on the ground that the plaintiff was contributorily negligent as a matter of law. The case went to the jury and the jury returned a verdict in favor of the plaintiff in the sum of $60,000.00. The defendant moved to set the verdict aside on the grounds that the defendant was contributorily negligent as a matter of law and upon the further ground that the verdict was excessive.…
