The offense is an assault with intent to murder; the punishment assessed is confinement in the state penitentiary for a term of two years.

It appears from the testimony adduced upon the trial that both the defendant and the injured party are negroes and that each of them had served a term in the state penitentiary. Appellant was a stepfather to Charlie Harris, the injured person.
