Appeal from a judgment of the Supreme Court (Cobb, J.), entered May 11, 1988 in Albany County, which, in a proceeding pursuant to CPLR article 78, granted respondents’ motion to dismiss the petition as untimely.

Petitioner was employed in a permanent status by respondent State Division of Equalization and Assessment (hereinafter the Division) when, by letter dated August 21, 1986, he submitted his resignation to respondent Joseph L.
