This is a petition in error, filed in the late district court, praying the reversal of the judgment of the court of common pleas of this county.

It is alleged in the “substituted petition” and the amendment thereto, filed in the court below, in substance, that .on the 9th day of October, 1877, the defendant, William C. Newell, was elected to the office of sheriff of Highland county. That on January 7th, 1878, his official bond in the penal sum of $10,000, with the other defendants, Samuel E.
