OPINION

By HORNBECK, P. J.

This is an appeal on questions of law from a judgment in behalf of the plaintiff-and against the defendant in the sum *628of $3,000.00 with costs, awarded on the verdict of a jury. The action was one for damages for personal injuries suffered by the plaintiff when he was struck by an automobile being operated by the defendant. There is no substantial variance in the record as to the happenings out of which the injuries suffered by the plaintiff arose.
