Appeal from a judgment of the County Court of Albany County (Breslin, J.), rendered August 11, 1999, upon a verdict convicting defendant of the crimes of murder in the first degree and burglary in the first degree.

The testimony at defendant’s trial established that Anthony Ingoldsby, the victim of the crimes of which defendant stands convicted, lived in a basement apartment at 51 Biberón Place in the City of Albany with two roommates, Georgie Cruz and Victor Swarez.
