The petitioner was appointed by this court as receiver of the insolvent defendant corporation. Upon his appointment he took over defendant’s bank account in the Orange Yalley Bank, in which account there was a small balance. Investigation disclosed that on September 26th, 1939, several months prior to the receiver’s appointment, when the defendant company had a bank balance of $1,933.75, the bank charged its account with $1,900, and credited that amount on demand collateral loans due the bank from the defendant.
