This is a suit in equity to enforce the specific performance of a contract for the sale of real estate. The terms of the contract are indicated in the condition of a bond given by the defendant to the plaintiff, on the 14th day of March, 1873. The terms were, that the plaintiff should pay for the land ten thousand dollars, on delivery of the deed, on or before the 1st day of April, 1873, and should assume a mortgage on the land for five thousand dollars, and that the defendant should, on or before the same day, deliver to the plaintiff a good deed of the land, subject to said mortgage, the…
