NIEMEYER, Circuit Judge:

The primary issue raised in this appeal is whether evidence of the defendants prior acts of witness tampering were properly ad mitted under Federal Rule of Evidence 404(b) to prove the element of intent in a later prosecution for a separate act of witness tampering in violation of 18 U.S.C. § 1512(b)(1).
